Waste Collection Bayswater Service Terms and Conditions

These Terms and Conditions govern the provision of waste collection services by Waste Collection Bayswater to domestic and commercial customers. By placing a booking or using our waste removal services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any collection.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, company, partnership or other entity that requests or receives waste collection services from Waste Collection Bayswater.

Service means any waste collection, removal, loading, transport, and related services provided by Waste Collection Bayswater.

Waste means any items, refuse, junk, rubbish, bulky waste, commercial waste or other materials to be collected, transported or disposed of by Waste Collection Bayswater under the Service, excluding any prohibited or hazardous materials as set out in these Terms and applicable law.

Agreement means the contract formed between the Customer and Waste Collection Bayswater when a booking is accepted and confirmed in accordance with these Terms and Conditions.

2. Scope of Services

Waste Collection Bayswater provides a range of waste collection and disposal services, including but not limited to domestic waste removal, commercial waste clearance, bulky item collection, and general rubbish collection. The precise scope of the Service for each booking will be set out in the confirmation provided to the Customer.

All Services are provided subject to the availability of vehicles, staff and any necessary equipment. Waste Collection Bayswater reserves the right to refuse to provide or continue any Service where, in its reasonable opinion, it would be unsafe, unlawful, or otherwise inappropriate to do so.

3. Booking Process

3.1 Booking requests

The Customer may request a booking for waste collection by telephone or through any other method made available by Waste Collection Bayswater. The Customer must provide accurate information regarding the type of waste, approximate volume or weight, collection address, access conditions, and any specific requirements.

3.2 Quotations

Any quotation provided by Waste Collection Bayswater is based on the information supplied by the Customer at the time of the request. Quotations are an estimate only and may be subject to adjustment if the actual waste or site conditions differ from those described. Quotations are valid for the period stated at the time they are given, or if no period is stated, for 30 days from the date of issue.

3.3 Booking confirmation

A booking will only be considered accepted and an Agreement formed when Waste Collection Bayswater confirms the booking to the Customer, verbally or in writing. Any provisional booking or quotation does not constitute acceptance. Waste Collection Bayswater reserves the right to decline any booking request at its discretion.

3.4 Customer responsibilities at booking

The Customer is responsible for ensuring that all details provided at the time of booking are complete and accurate, including access information, parking restrictions, and the description of the waste. Any changes to the booking details must be communicated to Waste Collection Bayswater as soon as possible and may result in a revised quotation or rescheduling.

4. Service Delivery and Access

4.1 Access to premises

The Customer must provide safe, suitable and lawful access to the collection address at the agreed date and time. This includes ensuring sufficient space for vehicles to park and load, and that any necessary permissions for parking or site access have been obtained in advance.

4.2 Attendance and waiting time

Waste Collection Bayswater will use reasonable efforts to attend the collection address within the agreed timeslot. However, times are estimates only and may be subject to delays due to traffic, weather, vehicle issues or other circumstances beyond reasonable control. The Customer must ensure someone is present to grant access and authorise the Service, unless otherwise agreed.

If access is delayed or denied due to the Customer, Waste Collection Bayswater may charge reasonable waiting time, an additional call-out fee, or treat the booking as a failed collection.

4.3 Failed collections

If Waste Collection Bayswater is unable to complete the collection due to incorrect address information, lack of access, absence of an authorised person where required, unsafe conditions or contravention of these Terms, the Customer may be charged a failed collection fee and any associated costs.

5. Waste Types and Regulations

5.1 Acceptable waste

Waste Collection Bayswater collects a wide range of domestic and commercial non-hazardous waste, including general household rubbish, furniture, appliances that are safe to handle, garden waste and non-hazardous business waste. The specific items accepted will be confirmed at the time of booking.

5.2 Prohibited and restricted items

The Customer must not present for collection any hazardous or prohibited waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, fuel, gas cylinders, explosives, radioactive materials, contaminated sharps, and any other materials classified as hazardous under UK waste legislation.

Certain items may only be collected subject to additional requirements, such as fridges and freezers containing refrigerants, electrical equipment requiring specialist handling, tyres, or items containing hazardous components. The Customer must declare such items at the time of booking so that appropriate arrangements can be made.

5.3 Duty of care and waste documentation

Waste Collection Bayswater will manage and dispose of collected waste in accordance with applicable UK laws and regulations, including the duty of care for waste management. Where required, a waste transfer note or other documentation will be produced and retained in line with legal requirements. The Customer agrees to provide any information reasonably requested for these purposes.

5.4 Environmental compliance

Waste Collection Bayswater aims to divert as much waste as reasonably practicable from landfill, through reuse, recycling and recovery, subject to regulatory and operational constraints. However, no guarantee is given that any particular item of waste will be recycled or reused.

6. Pricing and Payments

6.1 Service charges

Charges for waste collection are based on factors including the type and volume or weight of waste, labour time, access conditions, distance from vehicle to waste, and any additional services requested. Prices may be presented as a fixed price, banded volume price, time and materials rate, or a combination of these, as agreed at the time of booking.

6.2 Price adjustments

If, on arrival, the actual waste, site conditions or access differ significantly from those described by the Customer at booking, Waste Collection Bayswater may revise the price accordingly. If the Customer does not agree to the revised price, Waste Collection Bayswater may cancel the Service and charge a reasonable attendance or call-out fee.

6.3 Payment terms

Unless otherwise agreed in writing, payment is due on or before completion of the collection. Waste Collection Bayswater may require payment in advance, a deposit, or card details to secure a booking. Payment methods will be communicated at the time of booking and may include cash, card, or bank transfer.

6.4 Late payment

For business Customers with agreed credit terms, invoices must be paid by the due date stated. Waste Collection Bayswater reserves the right to charge interest and reasonable recovery costs on overdue amounts in accordance with applicable UK legislation on late payment of commercial debts.

7. Cancellations and Rescheduling

7.1 Customer cancellations

The Customer may cancel a booking by giving notice to Waste Collection Bayswater. If cancellation is made more than 24 hours before the scheduled collection time, any pre-payment may be refunded, less any non-recoverable costs already incurred. If cancellation is made within 24 hours of the scheduled time, Waste Collection Bayswater may retain all or part of the charge to cover lost time and costs.

7.2 Rescheduling

The Customer may request to reschedule a booking, subject to availability. Waste Collection Bayswater will use reasonable efforts to accommodate the request but is under no obligation to offer an alternative timeslot. Rescheduling requests made within 24 hours of the collection time may incur an additional charge.

7.3 Cancellations by Waste Collection Bayswater

Waste Collection Bayswater may cancel or suspend a booking at any time if:

the Customer fails to provide accurate information,

access to the site is unsafe, unlawful or not as described,

the waste presented includes prohibited or hazardous materials not previously disclosed, or

circumstances beyond reasonable control make it impracticable or unsafe to provide the Service.

Where Waste Collection Bayswater cancels a booking, any payments received for that booking will be refunded, except where the cancellation is due to the Customer's breach of these Terms, in which case reasonable costs may be retained.

8. Customer Obligations and Warranties

The Customer warrants that:

they are the owner of the waste or are authorised by the owner to arrange its removal,

the waste does not include any prohibited or hazardous materials, unless expressly agreed in writing,

all information provided is true, complete and not misleading, and

the collection site is safe and complies with applicable health and safety requirements.

The Customer is responsible for keeping children, pets and unauthorised persons away from the work area during the collection. The Customer must also take reasonable steps to protect driveways, surfaces and property where collection tasks are carried out, for example by notifying Waste Collection Bayswater of any fragile surfaces or access issues.

9. Liability and Limitations

9.1 General liability

Waste Collection Bayswater will perform the Service with reasonable care and skill. If the Service is not provided as agreed due to our fault, our liability will, at our option, be to re-perform the Service or refund the relevant portion of the charges paid by the Customer.

9.2 Property damage

Waste Collection Bayswater will take reasonable care to avoid damage to property while carrying out the collection. However, the Customer accepts that minor scuffs or marks may occur where waste is bulky or difficult to access. Waste Collection Bayswater is not liable for damage arising from pre-existing defects, fragile or poorly maintained surfaces, or where the Customer has requested that heavy items be removed through narrow or otherwise unsuitable access routes.

Any visible damage alleged to have been caused by Waste Collection Bayswater must be reported to us in writing as soon as reasonably practicable and in any event within 48 hours of completion of the Service, together with supporting evidence.

9.3 Exclusions of liability

Waste Collection Bayswater is not liable for any:

indirect, consequential or special loss,

loss of profit, revenue, business or opportunity, or

loss arising from delays, cancellations or rescheduling where caused by events beyond our reasonable control.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Indemnity

The Customer agrees to indemnify and keep indemnified Waste Collection Bayswater from and against all claims, costs, damages, fines, penalties and expenses arising from:

any breach by the Customer of these Terms and Conditions,

the presentation of prohibited, hazardous or misdescribed waste, or

failure to obtain necessary consents, permissions or authorisations for access or waste removal.

11. Data Protection and Privacy

Waste Collection Bayswater collects and processes personal data relating to Customers in order to provide the Service, manage bookings, process payments and comply with legal obligations. Personal data will be handled in accordance with applicable UK data protection laws. By using the Service, the Customer consents to the use of their information for these purposes, including reasonable communication about bookings, reminders and feedback requests.

12. Complaints

If the Customer is dissatisfied with any aspect of the Service, they should contact Waste Collection Bayswater as soon as possible, providing full details of the issue. Waste Collection Bayswater will investigate complaints in a timely manner and seek to resolve them fairly. The availability of any statutory or other dispute resolution rights is not affected by this complaints procedure.

13. Changes to Terms and Conditions

Waste Collection Bayswater may update or amend these Terms and Conditions from time to time. Any revised Terms will apply to new bookings from the date they are published or otherwise communicated. For ongoing or pre-booked Services, the version of the Terms in force at the time of booking will continue to apply, unless a change is required by law or agreed otherwise with the Customer.

14. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable by a court or competent authority, that provision will be deemed modified to the minimum extent necessary, or deleted, without affecting the validity and enforceability of the remaining provisions.

15. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation, are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any such dispute or claim, subject to any mandatory rights the Customer may have as a consumer to bring proceedings in other competent courts.

By placing a booking or using the waste collection services of Waste Collection Bayswater, the Customer confirms that they have read, understood and agreed to these Terms and Conditions.
